1.MAKENOTES VIRTUAL STORE
1.1 Purpose
These Terms establish the pre-contractual information, related to contracts concluded at a distance, on the website www.makenotes.pt referred to in article 4 of Decree-Law no. 24/2014 of 14 February, and of all subdomains / sub-websites.
The domain www.makenotes.pt is owned by MAISMAB - Artigos de Papelaria, SA, headquartered at Rua Senhora do Monte, nº 551, 4415-350, Pedroso, Vila Nova de Gaia, Portugal, legal person nº 514168412, which it is also its registration number at the Commercial Registry of Porto, with a registered capital of € 50,000.00, hereinafter referred to as Makenotes.
1.2 Intellectual property
All content and information contained in www.makenotes.pt and its subdomains are the property of Makenotes and therefore the use, reproduction, copying and dissemination, by other means, of logos, texts, images and videos on that website is subject to prior authorization to that effect.
2.OBJECT
2.1. The present General Conditions regulate:
2.1.1. The visit and access of Users to the website www.MAKENOTES.pt, in particular to the reserved area of customers (Customer Account) designated by “My Account” and to the MAKENOTES virtual store;
2.2. The order and purchase of products through the MAKENOTES virtual store always implies the knowledge of these General Conditions by the User and the Customer, which are expressly considered by them when accessing the respective Customer Account, as well as when ordering products through from the MAKENOTES store.
2.3. MAKENOTES may change these General Conditions at any time without notice and with immediate effect after its publication on www.MAKENOTES.pt. The Customer is bound by the sales conditions in force on the date of completion of his order, so he must consult them periodically.
3. CONDITIONS OF ACCESS AND USE
3.1. To access the MAKENOTES virtual store, prior registration as a Customer is required by filling in the form available online.
3.2. The Client is responsible for the veracity of the data communicated to MAKENOTES, being obliged, namely, to:
3.2.1. Do not use false identities;
3.2.2. Provide correct personal data, namely the tax identification number and address, so that MAKENOTES can correctly process orders;
3.2.3. Proceed immediately to the respective Customer Account with the changes that occur in the data communicated to MAKENOTES.
3.3. MAKENOTES may request the submission of supporting documents for the data indicated by the Client in the Online form.
3.4.1. MAKENOTES reserves the right to refuse registration as a Customer to anyone who does not meet the conditions for that purpose.
3.5. The Client may change his access code in the respective Client Account, and it is recommended that he do so in the first use and periodically;
3.5.1. The access code is personal and non-transferable and is for the exclusive knowledge and use of the Client, who must ensure its confidentiality, namely, by not disclosing it, nor revealing it to third parties and not operating under conditions that allow its decryption or copying.
3.5.2. MAKENOTES will not be liable for any losses caused by possible misuse of access codes that are not attributable to it as a fraud or serious fault.
3.5.3. Access by third parties to the reserved customer area and MAKENOTES store using the Customer access code that is in force, is considered done by the latter, whether they have authorization, for the purposes, namely, of data processing. orders.
3.6. Once registered, the Client accesses the MAKENOTES virtual store through the reserved area designated by “My Account” on the website www.MAKENOTES.pt, by indicating the respective username (“username”) and access code (“password ”).
3.7. MAKENOTES is not responsible for any impossibility or delay that occurs in the processing and delivery of the order as a result of an error or insufficiency of the personal data provided by the Client.
3.8. MAKENOTES reserves the right to eliminate the Client's Account that does not comply with the present General Conditions or that, in any way, performs any act that harms MAKENOTES and / or the operation of the MAKENOTES store.
4.ORDERING
4.1. In the reserved area, the Customer places his orders by inserting in the virtual shopping basket all the items he intends to purchase and follows the other purchase instructions that are requested to complete the order successfully.
4.2. The validation of the order corresponds to a purchase proposal and assumes that the Customer has accepted these General Conditions. The data recorded by MAKENOTES are proof of the transactions carried out through the MAKENOTES store.
4.3. After entering the online order, the Customer will receive an automatic email with confirmation of receipt by MAKENOTES of the order placed.
4.4. There is no minimum order value.
5.PRODUCT AVAILABILITY
5.1. The availability of the products presented in the MAKENOTES virtual store is limited to the stock available at each moment.
5.3 MAKENOTES only processes an order after confirmation of the respective actual payment, so there is no guarantee of availability of the product until the beginning of that processing.
5.4. In the event of unavailability of ordered products and / or out of stock, MAKENOTES can
- a) to propose to the customer the replacement of the missing product with another with similar characteristics, indicating
the respective price, or you can
- b) cancel the order in whole or in part, refunding the corresponding amounts paid to the Customer
part of the canceled order.
5.4.1. If the Customer agrees with MAKENOTES to replace the missing product with one with similar characteristics, MAKENOTES will refund the excess of the value in question to the Customer, if the replacement product has a lower price, or the Customer will pay the difference by the means available otherwise.
6.1. After payment confirmation, MAKENOTES will check the availability of the ordered products and, if applicable, confirm this availability to the Customer, communicating to by email, SMS or telephone the acceptance of the order.
6.1.1. The agreement between MAKENOTES and the Customer will only be made with confirmation of the availability of the ordered products.
6.2. MAKENOTES will inform the Customer of the order's shipment and estimated delivery date, indicating a code through which the Customer will be able to track the status of the order on the carrier's website.
6.3. Deliveries will take place at the delivery address indicated by the Customer when ordering (which will be your address by default), on business days, between 9:00 am and 6:00 pm.
6.4. Deliveries are only made in Continental Portugal. Shipping to the Azores and Madeira upon inquiry.
6.5. Deliveries in mainland Portugal have a shipping cost of € 3.95. The shipping costs are borne by the user and add to the total price of the products, being communicated before the user confirms the order and completes the purchase process. Costs depend on the delivery destination (address specified by the customer):
- For delivery services in mainland Portugal, shipping costs are € 3.95, except for purchases over € 29.90, for which the delivery service is carried out free of charge.
6.6. The risk of loss or damage to the products is transferred to the customer with the respective delivery.
6.7. MAKENOTES is not obliged to refund any amounts if the Customer refuses to receive the goods or does not proceed to pick them up.
6.8. The products are carefully prepared and packaged in the MAKENOTES warehouse; however, if the Client detects any evidence of violation of the packaging, he must immediately contact MAKENOTES and expose the situation through the number +351 229 958 865 or email info.online@makenotes.pt
7.MEANS OF PAYMENT
7.1.1. MAKENOTES provides the following means of payment for orders placed at the MAKENOTES store:
Payment options
Makenotes offers three alternatives for payment methods:
- Credit Card: the user must inform all the data requested. In case the payment platform informs you about not accepting the payment, the order will be automatically canceled.
- Paypal: when selecting this payment method, the user will be redirected to their PayPal page. When choosing to pay with PayPal, the billing address chosen previously will be ignored because only the address registered in the user's PayPal account can be used for billing purposes.
- ATM reference: when selecting this payment method, the user will have 48 hours, after confirming the order, to proceed with the payment of the same. They will find all the necessary information in an ATM, or on the internet through their bank's home banking services.
In any of these alternatives, just select, when paying, “PAYMENT OF PURCHASES”, followed by "SERVICES". The entire operation of selecting the payment method to be used and entering the data inherent to the order payment process is duly protected. All information is encrypted and managed with the most advanced security tools, being only accessed by Makenotes.

8.WARRANTY
8.2. If the product is defective or malfunctioning, the Customer must inform MAKENOTES within the legal deadlines by calling +351 229 958 865 or by email info.online@MAKENOTES.pt indicating the order number, the reference and the name of the product and describing the defect or malfunction in the CTT or Carrier's Guide upon receipt of the goods.
8.3. MAKENOTES is not responsible for damages resulting from the improper use or misuse of the products it sells or from the intervention of third parties or natural factors.
9.EXCHANGE AND RETURN OF PRODUCTS
9.1. The Customer has a period of 15 days to, if he wishes, proceed with the exchange or return of the purchased products (termination of the contract), without needing to invoke any reason, under the terms indicated below.
9.2. The customer must contact MAKENOTES by email or by the number +351 229 958 865, communicating his intention of exchange or return, which will be carried out on a date to be agreed.
9.3. Returns or exchanges will only be accepted under the following conditions:
9.3.1. Return of the item in its original conditions, accompanied by the respective proof of purchase (invoice or equivalent document), with the complete original packaging and all components and accessories;
9.3.2. CDs or DVDs with audio and video recordings, discs and software (software) can only be returned or exchanged in the original sealed packaging, unless there is a malfunction or defect, in which they will have to be exchanged for the same products;
9.3.3. If the purchase was paid by credit card or ATM, the Customer must present the respective receipt.
9.4. Items must not be returned without prior contact from the Client to MAKENOTES.
9.5. After contacting MAKENOTES and having received the instructions to proceed with the return or exchange, the Client must request MAKENOTES to collect them at the respective address.
9.5.1. The collection by the carrier at the Customer's address of the products for returns or exchanges does not mean the acceptance by MAKENOTES that the products are in a condition to be returned or exchanged.
9.6. MAKENOTES will check all products returned by the Customer, either by itself or through the carrier, and only those who respect the conditions set out in these General Conditions and other applicable legislation will be accepted for return or exchange.
9.7. If the Customer chooses to return the products, the refund of the respective amount will be made by bank transfer to the account with the NIB indicated by the Customer.
10.OTHER RIGHTS AND RESPONSIBILITIES
10.1. All data and content on the www.MAKENOTES.pt website, including trade marks, are the exclusive property of MAKENOTES or third parties and, as such, protected by law. The reproduction, transfer, distribution, or storage of the contents of the website www.MAKENOTES. en without prior written authorization from MAKENOTES.
10.2. It is strictly forbidden to introduce any link that you send directly to the website www.MAKENOTES.pt without prior written authorization from MAKENOTES, which can always and at any time, require the elimination of any link, even if authorized.
10.3. The images presented on the website www.MAKENOTES.pt are merely illustrative, and there may be some differences in relation to the product in question. The images may also contain, in some cases, props to show the product in its functionality, which are not included in the respective price. The Customer should always consult the product's characteristics to obtain detailed and accurate information about it.
10.4. MAKENOTES reserves the right, at any time and without prior notice, to change the contents of the www.MAKENOTES.pt website, namely about the products offered and their prices.
10.5. Despite all efforts that MAKENOTES will make so that the information presented on the website www.MAKENOTES.pt and in the MAKENOTES store, is free from errors, some inaccuracies may occur, namely with regard to prices, that MAKENOTES will try to correct it as soon as possible.
10.5.1. Without prejudice to the provisions of the following points, MAKENOTES does not assume responsibility for any errors in the content of the website www.MAKENOTES.pt and in the information provided;
10.5.2. However, before processing the order, MAKENOTES will check if there is an error in the prices advertised and that were considered by the Customer in his order. In case of a divergence and the price is lower than the advertised, MAKENOTES will return the difference to the Client; if the price is higher than the advertised price, MAKENOTES will contact the Customer by email or telephone to make the decision to accept the corrected price (paying the same) or to cancel the order in whole or in part.
10.6. MAKENOTES reserves the right to unilaterally cancel an order whenever there is a programming error, defect or malfunction in MAKENOTES 'computers and servers or if the contractual proposal reaches the target Customers with errors on essential elements of the contract.
10.7 The Customer can cancel his order until the payment is made.
10.7.1. If the payment of the order is not confirmed by MAKENOTES within ten days after receipt of the order, it will be automatically canceled.
10.7.2. After payment and fulfillment of the order, the Customer may return the products only under the terms and conditions defined in these General Conditions.
11.PRIVACY AND PROTECTION OF PERSONAL DATA
11.1. The treatment of personal data collected on the website www.MAKENOTES.pt is the responsibility of MAKENOTES, duly identified in these General Conditions, and the Client is guaranteed, under legal terms, the rights of access, rectification, communication, or deletion of his personal data through written request addressed to MAKENOTES sent to:

11.2. The Client authorizes MAKENOTES to automatically process his personal data collected on the website www.MAKENOTES.pt for the purposes necessary for contracting with Clients, order processing and communications with the Client, management and execution of purchases and respective records, processing of complaints and requests for information, access control and statistical analysis, including using "cookies" technology, and data can be accessed and consulted by MAKENOTES service providers, in particular legal, auditing and accounting services.
11.3. The Client authorizes MAKENOTES to use his personal data for the purposes of direct marketing and advertising through any communication channel, namely electronic mail, SMS, MMS or other forms of automatic communication.
11.3.1. The customer may at any time and without the need for justification, oppose this use by means of a communication addressed to MAKENOTES through the means referred to in point 11.1.
11.3.2. MAKENOTES will not sell or transfer its customer database to third parties.
11.4. The newsletters sent by MAKENOTES to Customers via e-mail are intended for the communicating promotions and general information. The Client will receive the "newsletter" upon registration in the respective list of subscribers or on the website www.MAKENOTES.pt, unless otherwise indicated in the registration form. If you wish to continue receiving the newsletter, the Customer will need to send an email to the address indicated in the newsletter at any time and without justification.
11.5. MAKENOTES collects and processes the personal data of customers in a safe manner and prevents their loss or manipulation, using appropriate techniques for this purpose and keeping its servers in safe conditions and with restricted and controlled access. However, MAKENOTES warns that the provision of data on an open network allows the circulation of the data with the risk of being seen and used by unauthorized third parties.
11.6. Computerized records are processed and kept by MAKENOTES in adequate security conditions; the communications between MAKENOTES and the Client will be confirmed by the respective computer record and the orders, invoices and other accounting documents proving the transactions will be filed in a reliable and long-lasting support, under the legal terms.
12.LEGISLATION AND COMPETENT JURISDICTION
12.1. All agreements and other acts and documents under these General Conditions are regulated by Portuguese law.
12.2. Disputes arising from agreements and other acts and documents under these General Conditions will be submitted to the corresponding competent Portuguese court.

13.3. It is agreed between MAKENOTES and the Client that, for the purposes of judicial summons or notices in the event of a dispute, they are considered to be domiciled at the respective postal addresses (MAKENOTES being the one of the respective headquarters and the Client being the one indicated in the online registration form as client), and the Client must inform MAKENOTES of any change in the domicile, by registered letter with acknowledgment of receipt, within 30 days after its occurrence, under penalty of not being considered.
14.HELP, SUGGESTIONS AND COMPLAINTS
Listening and perceiving customers is a priority of Make Notes, to improve and guarantee, at all times, their total satisfaction.

Shipping
